Terms and conditions of sale

These terms are the contract between you and us when you buy from discipline.fashion. We have kept them as short and plain as we can. They never take away rights that the law of your country gives you as a consumer.

1. Who we are

Discipline. is run by DynamicDigital sp. z o.o., a limited liability company under Polish law, registered office Aleje Jerozolimskie 181B, 02-222 Warszawa, Poland, entered in the National Court Register (KRS) under no. 0000521993 by the District Court for the Capital City of Warsaw, XIII Commercial Division, NIP/VAT PL5213678094, REGON 147391038, share capital PLN 5,000.00 ("we", "us"). 2. Who these terms are for

These terms apply to every order placed on discipline.fashion. The shop is for consumers: people buying for themselves or as a gift, not for resale. You must be at least 18, or have a parent or guardian's permission, to place an order. If you are a sole trader buying something that isn't of a professional nature for your business (judged by your registered business activity), you have the same withdrawal and conformity rights as a consumer, as Polish law provides. For other business purchases, write to us first; some consumer provisions below then don't apply by law, but we will usually honour them anyway.

3. The pieces

We sell four pieces (Vintage Tee, Classic Tee, Oversized Hoodie and Rib Beanie), each in two colours, with one of our fixed designs. Each piece starts as a Stanley/Stella organic cotton blank and is printed or embroidered for you after you order. The fabric, weight, fit, sizes and care of each piece are described on the shop page before you buy.

The product images are digitally generated previews made from photographs of the real garments. We work to keep them accurate, but because every piece is printed individually, small variations in colour shade, print size and position (a few millimetres) are normal and are not a defect. Screens also show colours differently.

The sentences are chosen from our own list. You can't submit your own text.

5. How an order works

  1. You choose a piece, colour, design and size, and add it to your bag. You can change or remove anything in the bag at any time.
  2. When you tap Checkout, you go to a secure payment page run by Stripe. There you enter your email, delivery address and phone number (for the carrier), and see a summary with the total price including shipping. You can go back and correct any mistake before paying.
  3. By tapping the pay button you place an order with an obligation to pay. The contract is concluded when your payment is authorised. We then send you a confirmation by email with the details of your order, these terms and the withdrawal form. Please keep it: we store your order but not a personal copy of these terms for you.
  4. The contract is in English.

We can refuse or cancel an order in exceptional cases, for example if a blank is suddenly out of stock, an address can't be served, or we reasonably suspect fraud. If so we tell you straight away and refund everything you paid.

6. Payment

You pay in full when you order, by card, Apple Pay, Google Pay, iDEAL or Bancontact, through Stripe. We never see or store your full card details. Stripe may carry out fraud checks and, where your bank requires it, ask you to confirm the payment (Strong Customer Authentication).

8. Your right to change your mind (withdrawal)

Although each piece is made to order, you choose from our fixed options, so the legal exception for personalised goods does not apply. You have 14 days from the day you (or someone you name, other than the carrier) receive the goods to withdraw from the contract without giving a reason. We offer the same right to customers everywhere, not only in the EU.

9. Guarantees

Legal guarantee

If you are a consumer in the EU, you have a legal guarantee of conformity of 2 years from delivery. If a piece is defective or not as described, you are entitled to a repair or replacement (for our pieces this means a new one), or if that is impossible or not done within a reasonable time, a price reduction or a full refund. Defects that appear within 2 years of delivery are presumed to have existed at delivery. Outside the EU, you have the guarantees that the law of your country gives you.

Our print promise

On top of that, if anything is off with your print (a misprint, the wrong sentence, the wrong colour or size), send us a photo and we will make it again for free, shipping included, or refund you if you prefer. This promise is free of charge and does not affect or replace your legal guarantee. Normal wear, damage from not following the care label, and the small variations described in section 3 are not defects.

10. Liability

We are responsible for foreseeable loss or damage caused by our failure to meet these terms or by our negligence. We are not responsible for loss that was not foreseeable, or for business losses (the shop is for consumers). Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or intentional fault, for defective products under product liability law, or for anything else that the law does not allow us to limit.

11. Designs and texts

The Discipline. name, wordmark, designs and the texts and images on this site belong to us or are used with permission. Buying a piece gives you the piece, not the right to reproduce the design. Quotations are credited to their authors.

12. Events outside our control

We are not responsible for delays or failures caused by events we can't reasonably control, such as strikes, carrier disruption, supplier shortages, extreme weather or pandemics. We will tell you, and if the delay is long you can cancel for a full refund of anything not yet delivered.

We use your personal data only to make, deliver and support your order and to meet our legal obligations. See the privacy policy.

14. Changes to these terms

We may update these terms. The version that applies to your order is the one shown on the site when you placed it, and sent with your order confirmation.

15. Complaints, law and courts

Write to us first at hello@discipline.fashion. We answer within two working days and respond to every complaint within 14 days. If you are a consumer and we don't respond to a complaint within 14 days, it is treated as accepted.

Consumers in the EU and EEA

These terms are governed by Polish law. If you live in another EU or EEA country, you also keep the protection of the mandatory rules of the law of your country. You can go to the courts of your country or of Poland.

Using out-of-court dispute resolution is voluntary for both sides; if we can't solve a complaint, we will tell you whether we agree to it. Consumers can get free help from their local consumer ombudsman (miejski or powiatowy rzecznik konsumentów) and can use mediation or the permanent consumer arbitration court at the Provincial Inspectorate of Trade Inspection in Warsaw (Wojewódzki Inspektorat Inspekcji Handlowej w Warszawie). The Polish competition and consumer authority UOKiK lists these bodies at prawakonsumenta.uokik.gov.pl. If you live in another EU country, the European Consumer Centre of your country can help for free.

Customers in Switzerland and elsewhere in Europe outside the EU

Polish law applies, without taking away any mandatory consumer protection of the country where you live. You can bring a claim in the courts of your country.

Customers in the United States and the rest of the world

Polish law applies, except where the law of your state or country requires otherwise. There is no arbitration clause and no class-action waiver: you can use the courts, including small-claims courts, available to you where you live. Nothing in these terms limits a right that you have under your state's consumer protection law and that can't be waived.

16. Other

If a court finds part of these terms invalid, the rest stays in force. If we don't enforce a right straight away, we can still do so later. You may not transfer your rights under this contract to someone else without our agreement, except that the legal and print guarantees pass to whoever you give the piece to as a gift.

17. Using the site (electronic services)

Besides selling, the site offers a few free electronic services: the piece configurator and preview, the bag (kept in your own browser), the withdrawal function and the links to contact us. You start using them by opening the site and stop by closing it or clearing your browser data; there is no account to create or close.
